GIVING NOTICE OF BUILDING WORK TO BIRMINGHAM CITY COUNCIL

Acivico (Building Consultancy) Ltd, is a wholly-owned company of Birmingham City Council and is its Agent in administrating building regulations and associated matters.

Unfortunately, we are unable to accept a Building Notice application under the following circumstances:

▪ Where a new building or the extension of a building is within 3 meters of a public sewer.
▪ Where building works are carried out to commercial buildings what are subject to the Regulatory Reform Order 2005 (R.R.O).
▪ Where the works involves the construction of a new building fronting onto a private street.

We are unable to accept a Building Notice in the following circumstances and would require a ‘Full Plans’ application which would require a little more information.

If one of the above are applicable to the project, then a full plans application form will be required (Domestic or Commercial form, depending on the building classification)

COMMENCEMENT STATEMENT

A date is required for when the proposed building work will be constructed to at least 15%:*

(see below notes for guidance)

Note (1): Where works consists of a Horizontal extension to a building, work is to be regarded as commenced when the sub-surface structure of the building or the extension including all foundations, any basement level (if any) and the structure of ground floor level is completed.
Note (2) where any works does not constitute a horizontal extension to a building/or a complex building, the work is regarded as commenced when 15% of any new works is placed. For example, the installation of a new structural or thermal element or the installation/extension of a controlled service or fitting.
Note (3): Where the work consists of the construction of a complex building, work is to be regarded as commenced in relation to that building or the first stage of building work for that building when the foundations supporting the building and the structure of the lowest floor level of that building (but not the other buildings or structures to be supported by those foundations) are completed.

SUBMITTING A BUILDING NOTICE APPLICATION

Important: For an extension to property or new building please also provide a plan to a scale of not less than 1:1250 and identify the building work on that plan.

Acivico are no longer accepting postal applications routinely, therefore please do not send postal application forms to this address without us first as we will need to make special provisions. We may be able to help you to register your application in another way.

Once registered, we will provide you with your unique Application Number (please quote this on any future correspondence) along with further contact details and payment options.
Building work will be inspected on site and once satisfied, we will issue a Completion certificate.
Be advised that upon completion of the works, a completion statement MUST be provided not more than 5 days after the works have been completed by any persons carrying out building work in accordance with Regulation 16(4) of the Building Regulations 2010.

NOTES TO THE CHARGING SCHEME

If your work falls into one of the above categories [A-J] this must be used. Reference to [K] should only be made where the work is outside the scope of [A-J] above.
Where more than one storey is involved the combined internal floor area should be used to calculate the fee.
Where different elements of work are shown upon the plans it may be that more than one charge is payable.
The ‘Estimated Cost’ is the full cost of the work must base upon a reasonable market rate + VAT, any professional fees, i.e., Architect, Engineer, Land Acquisition costs may be discounted from this calculation. In addition, decorative finishes, floor coverings and fittings, which are not subject to Building Regulation, can therefore be excluded from the estimate.
The council may assist in paying the building regulation application fees in some circumstances. For example, a WC or shower designed to meet the needs of a person with a disability, where that is shown to be for the benefit of a person, and where it will help them to continue to live in their dwelling. Please contact us if you would like further information about fee exemption.
The Application fee should be paid in full and is not refundable.
In rare circumstances where builder(s)/designer(s) require a great deal of support from the service, we may require additional payments to cover our additional time on the project.
A completion certificate will be withheld without the submission of a satisfactory completion statement, satisfactory completion inspection and full fee payment, following the withhold of a completion certificate, the applicant can appeal in writing to The Building Safety Regulator.
