APPLICATION FOR REGULARISATION OF BUILDING WORK. THE BUILDING ACT 1984 – BUILDING
REGULATIONS AS AMENDED.

 

Acivico (Building Consultancy) Ltd, is a wholly-owned company of Birmingham City Council and is its Agent in administrating building regulations and associated matters.

    The total fee must be paid upon submission of the Regularisation Building Regulations application.

    • If your work falls into one of the below categories, this must be used.
    • Any work that falls outside the scope of the below table(s) (1 & 2) will require a formal fee quote which will be provided upon request.
    • The ‘Estimated Cost’ is the full cost of the work must base upon a reasonable market rate. Professional fees, i.e., Architect, Engineer, Land Acquisition costs may be discounted from this calculation. In addition, decorative finishes, floor coverings and fittings, which are not subject to Building Regulation, can therefore be excluded from the estimate.
    • Where more than one storey is involved, the combined internal floor area should be used to calculate the fee.
    • Where different elements of work are shown upon the plans it may be that more than one charge is payable.
    • Where a charge category asks for measurements these are internal metric floor areas. Where more than one storey is involved the combined floor area should be used for charge calculation purposes.
    • If more than one element of work has been carried out, then it may be that more than one charge is payable, e.g. a loft conversion and a single storey kitchen extension.
    • VAT is not applicable to Regularisation applications.
    • A completion certificate will be withheld without the submission of a satisfactory completion statement (if applicable), satisfactory completion inspection and full fee payment, following the withhold of a Regularisation Certificate, an appeal process can be evoked in writing to The Building Safety Regulator.
    • The information supplied on this form may be shared with relevant parties within Birmingham City Council along with organisations charged with detection and prevention of fraud.

    • COMMENCEMENT STATEMENT

    • Note: Be advised that the commencement statement should only be completed for works that was carried out on or after the 1st October 2023

      • Note (1): Where works consists of a Horizontal extension to a building, work is to be regarded as commenced when the sub-surface structure of the building or the extension including all foundations, any basement level (if any) and the structure of ground floor level is completed.
      • Note (2) where any works does not constitute a horizontal extension to a building/or a complex building, the work is regarded as commenced when 15% of any new works is placed. For example, the installation of a new structural or thermal element or the installation/extension of a controlled service or fitting.
      • Note (3): Where the work consists of the construction of a complex building, work is to be regarded as commenced in relation to that building or the first stage of building work for that building when the foundations supporting the building and the structure of the lowest floor level of that building (but not the other buildings or structures to be supported by those foundations) are completed.
    • SUBMITTING AN APPLICATION TO REGULARISE BUILDING WORK

      • Acivico are no longer accepting postal applications routinely, therefore please do not send postal application forms to this address without contacting us first as we will need to make special provisions. We may be able to help you to register your application in another way.
      • Please send this form along with applicable plans, calculations, etc to: BuildingConsultancy@AcivicoGroup.co.uk. We endeavour to register your application within 2 working days of receipt.
      • Once registered, we will provide you with your unique Application Number (please quote this on any future correspondence) along with further contact details and payment options.

      I hereby deposit a Regularisation application in accordance with the BUILDING ACT 1984 – BUILDING REGULATIONS as amended.
    • *Upon completion of the works, a completion statement MUST be provided not more than 5 days after the works have been completed by any persons carrying out building work in accordance with Regulation 16(4) of the Building Regulations 2010.

      A copy of the Completion Statement will be provided to you upon request.

      *Note: The completion statement is only required for works carried out on or after the 1st October 2023.

    This application process may involve additional costs in terms of:
    a) Preparation of plans/details
    b) Exposing and correcting defective work.

     

    • Please provide a condition report from suitably qualified building surveyor (example RICS/CIOB) to confirm state of works undertaken, and the level of compliance of the work carried out. (Example calculations, photos, as-built plans etc)
    • For an extension to a property or new building, provide a plan to a scale of not less than 1:1250 and identify the building work on that plan.
    • We may request further information where appropriate.
    • Once received (depending on the nature of the work(s) in question) the surveyor may require certain parts of the work to be opened up or exposed for inspection in order to assess its compliance. In order to facilitate this procedure on site you may need the services of a builder or other suitably qualified person to assist you.
    • Where the work is found not to be in compliance with the Building Regulations, the surveyor will notify you accordingly.
    • Once the work is found to be in compliance with the Building Regulations, a Regularisation Certificate will be issued to you as confirmation.

    • Once an application has been deposited the charge cannot be refunded.
    • In rare circumstances where builder(s)/designer(s) require a great deal of support from the service, we may require additional payments to cover our additional time on the project.
    • A completion certificate will be withheld without the submission of a satisfactory completion statement (if applicable), satisfactory completion inspection and full fee payment, following the withhold of a completion certificate, the applicant can appeal in writing to The Building Safety Regulator.
    • The information provided on this form to Acivico (Building Consultancy) Limited will be processed strictly in connection with your application in accordance with the Data Protection Act 1998 and will not be used for any other purpose.
    • Acivico Building Consultancy operate in accordance with The Building (Local Authority Charges) Regulations 2010.

    WHAT HAPPENS NEXT

    Once the application has been validated (registered and payment received), your plans will be assessed by one of our surveyors who will provide Building Regulation compliance comments, if necessary, to help ensure the work meets the required standards (*NOTE: As the works are retrospective, no formal approval of plans will be issued).
    Building work will also be inspected on-site and once satisfied we will issue a Completion certificate.
